Sales Agreement

In consideration of a total purchase price of $899, of which $200 is a nonrefundable Surety of Action deposit received from Buyer, the Seller transfers in fee simple all rights, privileges and responsibilities associated with the ownership of the following, hereafter referred to as .dog.:


Additional terms of this sale are as follows:

A 180 day warranty from date of birth is given only on life threatening genetic defects. Seller requires that the dog to be taken to a licensed veterinarian within 48 hours of leaving the Seller's premises to activate warranty. The dog's genetic condition must be sufficiently serious in the opinion of two qualified veterinarians, at least one of whom is selected by the Seller, to warrant euthanization of the dog. If the dog should die for any reason, an autopsy must be performed to determine the actual cause of death. Seller will honor warranty only if the cause of death is the direct responsibility of the Seller. Seller shall provide a credit towards another dog or refund less the nonrefundable Surety of Action deposit during the 180 day warranty. Dog must be returned for any credit or refund along with all registration papers and veterinarian documents. If the dog has registration papers, there will be no credit or refund given without registration papers. Should Buyer's dog be replaced due to any covered terms of this warranty, Buyer will be held responsible for any shipping and documentation fees. Seller only offers credit toward another dog and does not offer any exchanges due to the fact that prices may vary with the quality, size and the type of registration of the dog. No monies will be refunded to Buyer if Buyer chooses to exchange for a puppy that does not amount to the original purchase price of the dog. If Buyer does not have the dog checked out by a licensed veterinarian within the first 48 hours, Buyer agrees to take the dog AS-IS with no warranty of any kind. This warranty shall become void if it is brought to our attention that the dog has been abused in any way. Abuse shall be considered as lack of proper housing, lack of proper diet, lack of veterinary care, physical abuse, and lack of human contact. If the dog has been abused, Buyer shall surrender all rights of the dog back to Seller and any expense to bring the dog back to full health shall be Buyer's responsibility. Seller's maximum liability for refund is limited to the purchase price of the dog less the nonrefundable Surety of Action deposit for any and all warranty claims.

Seller does not guarantee dog against illnesses brought on by the stress of entering into a new home, being separated from the dog's litter mates and mother, shipping in a car or plane, or a sudden change in dog's diet. This stress can ignite illnesses such as hypoglycemia (low blood sugar) or coccidia that is dormant in most live animals. Seller also does not guarantee against parasites (ie. worms, fleas, mites) as this is an on-going process that once the dog is out of Seller's control, would be the responsibility of the Buyer. Seller will not be held responsible for Buyer's "inability to respond" to the needs of the dog. All dogs are sold current on shots and wormings appropriate for the dog's age. These records are given at the time of sale. Some veterinarians do not recognize any shot not given in their office and care and require that you start the shots all over. It is best to follow the recommended schedule given by the Seller for the shots. Seller will not be held responsible if Buyer allows the veterinarian to start the shots all over as it is detrimental to the health of the dog.

Buyer agrees to provide dog with shelter, food and water, health care, companionship, and training. Buyer agrees to keep this dog as a pet and will not allow the dog to be used for research or any non-pet use. Buyer agrees to care for this dog for its lifetime. Seller will not be held responsible for any third party sales. Seller assumes no responsibility for the dog after leaving the premises; medical expenses, landlord disapproval, allergies, accident of any kind, or for any reason other than that stated. Seller does not refund any veterinary or medical bills Buyer decides to make. All veterinary and medical bills (including medications) are Buyer's responsibility. Seller assumes no responsibility for any illness or injury (physical or emotional) that occurs in any animals (including the dog itself), people or it's possessions as a result of being exposed to the dog. Seller is always willing to give advice or help in a reasonable way in which the welfare of the dog is of primary concern.

Seller only charges for pet quality dogs and this dog is being sold as such. Seller does not guarantee the size, color, markings or temperament of sold dog. All pet quality dogs should be spayed or neutered and not be bred. Seller does not guarantee the breed-ability or stud-ability of any dog sold. Seller is not responsible for any illness or death that could have been avoided by simply spaying or neutering the dog. If Buyer intends to breed or show, Buyer is doing so at own risk and Seller shall not be held liable in any way.

If this dog comes with registration papers, it will be given at the time of sale or will be mailed in a reasonable period of time.

If Buyer cannot keep the dog, Seller will take back the dog no questions asked, but no refund or other animal will be given as replacement. This is for the good of the dog not to end up in a bad home or shelter.
